These are the terms and conditions of Soul Emporium.
This page tells you the terms on which you may use our website, soulemporium.com (“Website”) and purchase our goods. Please read carefully before use.
By using our Website or purchasing our goods, you accept these terms and agree to obey them and a legally binding contract is formed between you and us. If you don't accept them, please don't use our Website or purchase our goods.

Use of our Website
The information contained on our Website is not directed to, nor intended for, distribution or use by any person or entity in any jurisdiction where the publication or availability of this Website, or such distribution or use, would be contrary to local laws or regulation. You shouldn’t access our Website/information on our Website if you know that your access would contravene applicable, local, national or international laws.
You have permission for temporary use of our Website, but we can withdraw or change our Website at any time without telling you and without being legally responsible to you. You are only eligible to use our Website if you are at least 18 years of age, or have capacity to form a binding contract, and if you are not a user barred from accessing our Website under applicable law. Your use of our Website must not violate any applicable law or regulation.
You must treat all identification codes, passwords and other security information as confidential. If we think you have failed to keep confidentiality, we are allowed to disable any security information (including your passwords and codes).

We do our best to protect our Website, but are not responsible for bugs, viruses etc., and are not liable for damage or loss caused by a virus, distributed denial of service attack or other technologically harmful material that may infect your computer equipment, computer programmes, data or other proprietary material due to your use of our Website, downloading any content from it or using any website linked to it.
We don’t warrant that your use of our Website will be uninterrupted or error-free. We are not responsible for any loss or damage suffered as a result of any interruptions or errors, and you acknowledge that our Website may be subject to limitations, delays or other issues.
We do our best to provide the most accurate information possible. However, we cannot ensure that our Website is completely error free, or that it will not become outdated. Therefore, we do not provide any warranty or other assurances as to the completeness, accuracy, timeliness or fitness for particular purposes of any of the content or materials contained within our Website.
We are also not liable for any third party content on our Website, and do not endorse what this content may contain.
These terms and conditions remain effective so long as you use our Website.
We follow our privacy policy in handling information about you. By using our Website, you agree to us handling this information and confirm that data you provide is accurate.
Intellectual property rights
We are the owner or licensee of all intellectual property rights in our Website and in the goods that we sell (for example the copyright and any rights in the designs) and in any of the material posted on it. They are protected by copyright.
You are allowed to print one copy and download extracts of any page on our Website for your personal reference, but not for commercial use without a licence from us. You must not alter anything, or use any illustrations, video, audio or photographs separately from the text that goes with them. You must not change, copy, reproduce or translate anything on the site without our consent. You are not permitted to license, sell, rent, lease, transfer, assign, distribute, exploit or otherwise make any documents or online resources from the site available to any third party.
If you breach these terms, you lose your right to use our Website, and must destroy or return any copies you have made.
Our legal responsibility to you
As far as legally possible, we exclude legal responsibility for loss of income, profit, business, data, contracts, goodwill or savings, or any other indirect, consequential or special loss.
We also exclude, as far as legally possible, all terms and warranties or promises implied by law or by statutes.
We don't exclude legal responsibility for death or personal injury owing to our negligence, or legal responsibility for fraud or fraudulent misrepresentation, or for anything else where exclusion is not allowed by the law.
Uploading to our Website
Material that you upload will be regarded as non-confidential and not owned. This means that we can copy it, distribute it, and show it to other people for any purpose. You agree that if anyone else claims to own the material, or says that it breaches their rights, we can give them your identity.
We won't be legally responsible to anybody for the accuracy of material that you upload to our Website, and we can remove it at any time.
Computer offences
If you do anything which is a criminal offence under a law called the Computer Misuse Act 1990, your right to use our Website will end straightaway. We will report you to the relevant authorities and give them your identity.
Examples of computer misuse include introducing viruses, worms, Trojans and other technologically harmful or damaging material.
You mustn't try to get access to our Website or server or any connected database or make any 'attack' on our Website. We won't be legally responsible to you for any damage from viruses or other harmful material that you pick up via our Website.
Links to our Website
You are allowed to make a legal link to our Website's homepage from your website provided the content on your site meets our standards, it is done so fairly and legally, and does not damage our reputation or take advantage of it. We can end this permission at any time.
You must not suggest any endorsement by us or association with us unless we agree in writing.

Links from our Website to other websites are for information only. We don't control them and don't accept responsibility for other websites or any materials found upon them or any loss you suffer from using them.

Our goods
The images of the goods on our Website are for illustrative purposes only. Although we have made every effort to display the colours accurately, we can’t guarantee that a device's display of the colours accurately reflects the colour of the goods. Your goods may vary slightly from those images.
The packaging of the goods may vary from that shown in images on our Website.
Your right to make changes
If you wish to make a change to the goods you have ordered please contact us. We will let you know if the change is possible. If it is possible we will let you know about any changes to the price of the goods, the timing of supply or anything else which would be necessary as a result of your requested change and ask you to confirm whether you wish to go ahead with the change.
Delivery
The costs of delivery will be as displayed to you on our Website.
During the order process, we will give you an estimated delivery date and we aim to ship your order as soon as commercially practicable after you have placed your order. We have no control or influence over the time taken between shipping and delivery and this will depend on the courier used, which is currently Royal Mail but we reserve the right to change the courier service from time to time. Please note that delivery times will vary depending on the time of year and we cannot guarantee that you will not experience any seasonal delays. We accept no liability whatsoever on behalf of the courier for late or delayed delivery.
The goods will be your responsibility from the time the goods are delivered to the address you gave us.
Consumer rights
You are entitled to consumer rights which include rights relating to any goods that are faulty or not as described. To find out more, you should contact your local Citizens’ Advice Bureau or Trading Standards office. Nothing in these terms will affect these legal rights.
In case you receive goods that aren’t of satisfactory quality, or the wrong item was sent, you can contact us at orders@soulemporium.com for a replacement or, where this isn’t possible, for a refund. You may need to return the goods to us and we will refund you the cost of delivery (as long as you keep your postal receipt) once it has been received. We will refund you within 7-10 working days of receiving the returned goods.
We sell crystals which are by their nature imperfect – that is to say that they may have little chips or cracks. Unless the crystal is substantially damaged so as to affect its appearance, we will not process any replacements or refunds as it cannot be reasonably said that the crystal is not of satisfactory quality.
Jewellery and crystal bracelets are carefully inspected before dispatch. Normal wear and tear, including chain or clasp breakage, cord wear, elastic stretching or snapping through regular use, tarnishing, accidental damage, snagging, impact damage, and damage caused by water, perfumes, cosmetics or improper storage are not considered manufacturing defects.
If you change your mind about the goods, under consumer legislation you have 14 days from the date of receipt of the goods to return them for a refund but you will need to pay the return delivery costs. Original shipping charges may not be refundable except where required by applicable consumer protection laws. We will refund you within 7-10 working days of receiving the returned goods.
For international returns due to a change of mind, customers are responsible for all return shipping costs, customs duties, taxes, import fees, brokerage charges and any other costs associated with returning an item.
If the goods arrive to you damaged, please contact us with a clear photo of the damage. You may need to return the goods to us, in which case, we will refund you the cost of delivery (as long as you keep your postal receipt) once it has been received, or we may send you a return postage label. Please email us at orders@soulemporium.com to let us know you will be returning/exchanging the goods in advance.
On the other hand, if the goods are faulty for any reason, please email us at orders@soulemporium.com. We’ll do our best to assist you and talk through your concerns and refund where necessary. Where goods are confirmed to be faulty, damaged, incorrect or not as described, we will provide an appropriate remedy in accordance with applicable consumer protection law.
Digital products, downloadable content, guided meditations and gift cards are non-refundable once access has been provided or the download has commenced, except where required by law.
Nothing in these terms will affect these legal rights.
GENERAL
We change these terms from time to time and you must check them for changes because they are binding on you.
These terms are our entire agreement. No previous statements or representations that we have made to you form part of these terms unless they are written into it. This includes, but is not limited to, information included on webinars, social media or discussed on sales calls.
If any provision of these terms is held to be illegal, invalid or unenforceable in whole or in part, such provision or part of it shall be deemed not to form part of these terms, and the legality, validity and enforceability of the remaining terms shall not be affected.
We sell crystals and we offer meditation and rituals on the use of these crystals. While the crystals, and some of the other goods we sell, are intended to result in certain outcomes for you, we do not guarantee these outcomes, or that you will achieve any particular results while using our goods. We are not medically trained nor do we hold ourselves out as such. We do not provide medical, mental health, therapeutic, or health advice and if you require such advice you should contact a professional as appropriate.
Applicable law
The parties will use their best efforts to negotiate in good faith and settle any dispute that may arise out of or relate to this Agreement or any breach of it.
Any dispute shall not affect the parties' ongoing obligations under the Agreement.
The courts of England and Wales have the only right to hear claims related to our Website or the sale of goods and all disputes are governed (including regarding non-contractual obligations) by English law.
